Information and request for consent to the processing of personal data pursuant to Article 6.1A of Regulation (EU) 2016/679

In compliance with the obligations set forth in Regulation (EU) 2016/679 on the processing of personal data, effective as of 25 May 2018, we hereby inform you that the company Stargroup. tech Srl, with registered office in Via Volta, 5, 25050 Provaglio d’Iseo (BS), Italy (hereinafter the ‘Company’), will process personal data concerning you that has been or will be provided to us by you or by others. The processing of personal data will be carried out in compliance with the regulations in force and under the following conditions.

1. Purpose of the processing

The processing of personal data is aimed exclusively at achieving the following purposes:

a) for requirements prior to the conclusion of sales contracts, to execute the same and to protect the positions of creditors and those deriving therefrom;

b) to fulfil any type of obligation provided for by laws or regulations in force, in particular, in tax matters;

c) for operational, management and accounting requirements;

d) to record access to the Company’s website and the use of the services provided through that website;

e) for the purposes of monitoring the progress of customer relations and/or related risks and improving those relations;

f) for commercial and strategic and operational marketing purposes.

In addition to collection, data processing may consist of recording, organising, structuring, storing, adapting, modifying, extracting, consulting, using, communicating by transmission, dissemination or any other form of making available, comparing or interconnecting, limiting, erasing or destroying data and shall be carried out using paper-based media or electronic and telematic tools, in accordance with methods and using tools that guarantee the security and confidentiality of the data, in compliance with the provisions of Articles 32 et seq. of Regulation (EU) 2016/679 on the ‘security of personal data’.

In particular, all technical, IT, organisational, logistical and procedural security measures appropriate to the level of risk will be adopted, depending on the nature of the data.

Furthermore, the methods applied guarantee that access to the data is only permitted to persons appointed by our Company to process it.

3. Provision of data

The provision of data is:

a) Mandatory for the purposes related to the obligations provided for by law or other binding regulations;

b) Necessary for the proper establishment and continuation of the relationship with you.

Any refusal to provide the above data, although legitimate, could compromise the regular performance of the relationship with our Company and, in particular, could make it impossible for us to execute your orders, as well as to provide the requested services and related invoicing.

4. Communication and dissemination of data

The external communication of personal data collected for the purposes referred to in point 1 may only take place where:

a) such communication is mandatory to ensure compliance with obligations laid down by law or other binding regulations;

b) such communication is mandatory to ensure the proper establishment or continuation of the business relationship with you.

Personal data collected for the purposes indicated above may be communicated, within the limits of their specific competence, to public and private entities, natural and/or legal persons, for commercial and/or management purposes relating to information systems and/or payment systems, including external data processors and sub-processors who perform specific tasks on behalf of our Company.

In particular, the data may be communicated to the following categories of entities: commercial network, banks and companies specialising in payment management, law firms and consultancies, entities responsible for auditing our company’s financial statements, public authorities or administrations for legal compliance, Italian and foreign suppliers, finance and transport companies, third parties responsible for quality control of the logistics and commercial flow, as well as other companies belonging to our Group.

The data may also be disclosed, but only in aggregate, anonymous form and for statistical purposes in accordance with the law.

5. Transfer of data abroad

Within the limits strictly necessary for the execution of the contractual relationship with you, your personal data may be disclosed to third parties (such as suppliers) located abroad, within or outside the European Union, always in compliance with the provisions of Articles 44 to 50 of Regulation (EU) 2016/679.

6. Rights of the data subject

Pursuant to Articles 12 and 15 to 22 of Regulation (EU) 2016/679, you have the right to request, under the conditions and within the limits of the aforementioned regulation, to:

9. Consent to processing

Finally, we would like to inform you that your consent to the processing of your personal data in the manner and for the purposes described above is optional.
